These Terms & Conditions ("Terms") govern your access to and use of the SwiperWiper mobile application and related services (collectively, the "Service") provided by SwiperWiper ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
2. Description of the Service
SwiperWiper is a photo and video organization tool that allows you to sort media from your device's library, mark items for deletion, review selections before confirming, and earn in-app rewards including virtual currency ("Acorns") and a virtual companion ("Swiper"). The Service operates locally on your device and does not upload your photos or videos to our servers unless explicitly stated otherwise.
3. Photo and Video Deletion
SwiperWiper helps you identify photos and videos you may wish to delete. You are solely responsible for reviewing all items marked for deletion before confirming. Once you confirm deletion, removed media may not be recoverable. We strongly recommend maintaining backups of important files. We are not liable for any loss of data resulting from your use of the Service.
4. Permissions
The Service requires access to your device's photo library to function. You grant the app permission to read and, when you explicitly confirm, delete selected media from your library. You may revoke photo library access at any time through your device settings, though this will limit app functionality.
5. Push Notifications
SwiperWiper may offer optional push notifications to personalize your companion experience. If you enable them, the App may notify you when Swiper needs care (such as food, water, rest, or attention) and send a daily friendly reminder that Swiper misses you or would enjoy a visit.
Notifications are delivered through your device's operating system and are scheduled locally on your device. They do not give us access to your photos, videos, or personal media. You may enable or disable notifications at any time in the App or through your device settings. Disabling notifications will not affect core gallery features, but you may miss care and check-in reminders.
By enabling notifications, you consent to receive these messages as described in our Privacy Policy.
6. Virtual Items and Gameplay
Acorns, quests, achievements, shop items, and Swiper's vitals and progression are virtual, in-app features with no real-world monetary value. They cannot be exchanged for cash, transferred to other users, or redeemed outside the Service. We may modify, balance, or discontinue virtual items and gameplay mechanics at any time without notice or compensation.
7. Purchases and Subscriptions
If the Service offers in-app purchases or subscriptions, payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings. Refunds are handled in accordance with Apple's policies.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, decompile, or modify the app
- Interfere with or disrupt the Service or its security features
- Use automated tools to manipulate gameplay or rewards
- Resell, sublicense, or redistribute the Service without authorization
9. Intellectual Property
The Service, including its design, code, graphics, characters (including Swiper), trademarks, and content, is owned by SwiperWiper and protected by intellectual property laws. You retain ownership of your photos and videos. We claim no ownership over your personal media.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DELETION OPERATIONS WILL BE ACCURATE IN ALL CASES.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIPERWIPER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR DEVICE MALFUNCTION, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.
12. Changes to the Service and Terms
We may update the Service or these Terms at any time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
13. Termination
You may stop using the Service at any time by uninstalling the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.
14. Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware, except where prohibited by applicable consumer protection laws in your jurisdiction.
